Thank you for accessing the Site which is owned and operated by A. Mistry Limited (“AML”), a company incorporated in England and Wales (Company No. 2917036), from its registered offices located at Park House, Unit 5 Falcon Business Park, Meadow Lane, Loughborough, LE11 1HL. AML trades under the name Kids Travel 2. Although the site is accessible worldwide, AML makes no representation that the Site is appropriate or available for use in other locations. Access to the Site from territories or nations where any aspect of the Site is illegal is prohibited. Your access to this Site, especially from outside of the United Kingdom, is of your own volition and you are responsible for compliance with all applicable local laws. AML reserves the right to limit, in its sole discretion, the provision and quantity of any product as well as access to this Site to any person or geographic area.

 

2. Who may use the site

The Site is for visitors who wish to find out more about our business and for visitors who wish to purchase our products ("you").

AML reserves the right to revoke this consent to link at any time at its sole discretion.

 

10. Information you submit to the site

All personal data we ask you to submit to the Site will be treated in accordance with the Privacy & Cookie Policy. Please note, AML will fully cooperate with any law enforcement authorities or court orders requesting or directing it to disclose information (including personal data) that we have obtained through your use of the Site. All information you submit to the Site, whether solicited or unsolicited will not be regarded as confidential. AML also welcomes your feedback and suggestions about how to improve this Site. By transmitting any suggestions, information, material, or other content (collectively, "feedback") to AML you represent and warrant that such feedback does not infringe the intellectual property or proprietary rights of any third party (including, without limitation, patents, copyrights, or trademark rights) and that you have all rights necessary to convey such feedback to AML In addition, any feedback received through this Site will be deemed to include a royalty-free, perpetual, irrevocable, transferable, non-exclusive right and license for AML to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works, and display (in whole or in part) worldwide, or act on such feedback without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such content, and you hereby waive any claim to the contrary. You can submit your details for inclusion in AML's mailing list. AML reserves the right to require you to submit a different user name if the chosen name is inappropriate or already in use. You must inform AML through our contact us page if you become aware of any misuse of your user details. Registration is open to any person over the age of 18. AML reserves the right to temporarily or permanently suspend your use of the Site and/or your user account, if you breach these Terms of Use, or for any other reason, and to inform law enforcement agencies or other relevant parties of particular breaches at its discretion. AML will gather, use and store the data you submit in accordance with its Privacy Policy. By registering, you agree that AML may use the data submitted at the time of registration to contact you for the purposes of the sale and delivery of Pieces.

 

11. Limitation of Liability 

To the fullest extent permitted by law, AML, its affiliates, licensors, service providers, content providers and their employees, agents, officers and directors will not be liable for, direct, loss, indirect, consequential, special loss and/or loss of profits, business interruption, loss of data, information or programs or your information handling system, pain and suffering or emotional distress arising out of or in connection with the use of, or inability to use, the Site, its content, materials or functions, whether in action of contract, negligence or other tortious action.

No waiver by AML of any breach of any obligation arising under these Terms of Use shall constitute a waiver of any other breach and no failure to exercise or to partially exercise by AML of any remedy shall constitute a waiver of the right subsequently to exercise that or any other remedy.

 

14. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed and enforced in accordance with the laws of England. The courts of England are to have exclusive jurisdiction to settle any disputes arising out of or in connection with the use of the Site. A printed version of these Terms of Use and of any related notice given in electronic form shall be admissible in judicial or administrative proceeding based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

If any of these Terms of Use should be determined to be illegal, invalid, or otherwise unenforceable by reason of the laws of any jurisdiction in which these Terms of Use are intended to be effective, then it shall be modified to the extent necessary, and only within the jurisdiction in which that Term is illegal, invalid or unenforceable, so as to achieve as nearly as possible the objectives of these Terms of Use or, if such modification is not commercially practicable as determined by AML in its sole discretion, it shall be severed and deleted from these Terms of Use and the remaining Terms of Use shall survive, remain in full force and effect, and continue to be binding and enforceable.

 

16. Online Purchases, Specific Programs, Other Terms and Conditions

Additional notices, terms, and conditions may apply to the purchase of Pieces, participation in a particular program, and/or to specific portions or features of the Site, all of which are made a part of these Terms of Use by this reference. You agree to abide by such other notices, terms, and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such program, service, or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Site, including any areas to enable the on-line purchase of items, or for any program or service offered on or through the Site, the latter terms shall prevail with respect to your use of that portion of the Site. AML obligations, if any, with respect to its services, programs, and/or products are governed solely by the terms, conditions, notices, and agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such terms, conditions, notices, and agreements.

 

17. Pricing and Tax

All prices shown are in UK Pounds Sterling. Where VAT is applicable then it will be included in the price you see.

 

18. Cancellation Policy

In accordance with statutory law (Consumer Contract Regulations), you may cancel your order at any time without reason, by returning the goods and/or giving us notice within 14 working days of delivery. If your order consists of multiple goods, the 14 days runs from when you get the last of the batch.

This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to send the goods back. You will be refunded within 14 days of our receipt of the goods, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is sooner. 

Please note that it is your responsibility to take care of the products and ensure they are returned to us safely & in a saleable condition. A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary. The extent to which a customer can handle the goods is the same as it would be if you were assessing them in a shop.

19. Returns Policy & Customer Satisfaction

We hope you will enjoy our products but if you are not entirely satisfied or in the unlikely event that the product is damaged/faulty please contact us in the first instance at the following address: info@kidstravel2.com. We will do our best to resolve any situation by either replacing the product or refunding the cost of the product. We regret that postage & packaging are direct costs and cannot be refunded in all circumstances. If the return is required as a result of our error, we will happily refund both the outbound & the return postage charges. Postage is at customer cost and it is recommended a proof of postage certificate is obtained. No refunds will be made for items returned, but not received by us if no proof of posting was obtained. In all other circumstances, the cost of return postage and the original postage charge are both non-refundable. In the case of a cancellation only basic delivery costs will be refunded in accordance with the Consumer Contracts Regulations.
